Privacy Policy

1. Information We Collect

We collect the following data to operate EmilyAI and provide personalized product recommendations:

• Shopify Store Data: Upon installation, we sync product information (e.g., product IDs, titles, handles, descriptions, prices, inventory quantities, images, tags, vendor details, and creation dates) and purchased product data (e.g., customer IDs, order dates, and product details) from your Shopify store.
• Customer IDs: We use Shopify-provided customer IDs to link purchased products to users for personalization purposes. No other personal identifiable information (e.g., names, email addresses, or payment details) is collected or stored by us.
• Technical Data: We log basic usage data (e.g., errors, sync timestamps) to ensure the App functions correctly, stored securely in our logs.

2. How We Use Your Information

The collected data is used solely to:

• Sync your store’s product catalog and purchase history with our database for personalized recommendations.
• Manage subscription plans (Free, Standard, Pro) and app functionality.
• Monitor and troubleshoot technical issues via logs.
• Comply with Shopify API requirements and legal obligations.

We do not use your data for advertising, profiling, or any purpose beyond the App’s core functionality.

3. Data Storage and Security

We store data using Supabase, a third-party database provider, with Shopify access tokens encrypted using AES-256-CBC encryption. Logs are stored locally on our servers. We implement reasonable security measures (e.g., encryption, access controls) to protect your data; however, no system is immune to breaches, and we cannot guarantee absolute security.

4. Data Sharing and Disclosure

We do not sell, trade, or share your data with third parties except:

• Shopify: As required to integrate with their API and comply with their terms.
• Supabase: For secure data storage.
• Legal Obligations: If required by law, court order, or to protect our rights, property, or safety.

5. Data Retention and Deletion

We retain data as long as your store uses EmilyAI. Upon uninstallation:

• All product and purchase data is deleted via Shopify’s shop/redact webhook.
• We retain only your trial end date in a separate "deleted_shops" table to manage reinstallation eligibility.

Customers can request data deletion via Shopify’s customers/redact webhook, which we honor by removing their purchase data.

6. Your Rights

You may:

• Request access to synced data.
• Request deletion of your store’s data (automatically handled upon uninstallation).
• Contact us to inquire about your data at support@softio.online.

7. Cookies and Tracking

EmilyAI does not use cookies, trackers, or analytics tools beyond what Shopify may employ in its admin interface.

8. Children’s Privacy

Our App is not intended for use by individuals under 13. We do not knowingly collect data from children.

9. Changes to This Privacy Policy

We may update this policy periodically. Changes will be posted here with an updated effective date. Continued use of the App constitutes acceptance of the revised policy.

Terms of Service

10. Acceptance of Terms

By installing or using EmilyAI, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

11. Eligibility

You must be a Shopify merchant with a valid store to use EmilyAI. You represent that you have the authority to bind your store to these terms.

12. Subscription Plans

We offer three plans:

• Free: Basic features, no cost, limited personalization.
• Standard: Enhanced features for growing stores, billed via Shopify.
• Pro: Full access to all tools, billed via Shopify.

Pricing and billing are managed by Shopify. You are responsible for reviewing and approving charges in your Shopify admin panel.

13. License and Usage

We grant you a non-exclusive, non-transferable, revocable license to use EmilyAI for your Shopify store, subject to these terms. You may not reverse-engineer, modify, or redistribute the App.

14. Prohibited Conduct

You agree not to:

• Use the App for illegal purposes.
• Attempt to bypass security measures or access unauthorized data.
• Overload our servers or disrupt service.

15. Termination

We may suspend or terminate your access to EmilyAI at our discretion, with or without notice, for any reason, including violation of these terms. Upon termination, all data will be deleted per our retention policy.

16. Disclaimers and Limitation of Liability

Disclaimer: EmilyAI is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted service, accuracy of recommendations, or that the App will meet your expectations.

Limitation of Liability: To the fullest extent permitted by law, Softio, its affiliates, and employees shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of EmilyAI, including but not limited to lost profits, data loss, or business interruption, even if advised of the possibility of such damages. Our total liability, if any, shall not exceed the amount you paid for the App in the prior 12 months.

No Responsibility: We are not responsible for errors in synced data, third-party actions (e.g., Shopify, Supabase), or any harm resulting from your use of the App. You assume all risks associated with its use.

17. Indemnification

You agree to indemnify and hold Softio harmless from any claims, damages, or expenses (including legal fees) arising from your use of EmilyAI or violation of these terms.

18. Governing Law

These terms are governed by the laws of Slovakia, excluding conflict of law principles. Disputes shall be resolved in the courts of Slovakia.

19. Force Majeure

We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, cyberattacks, or third-party service outages).
